Lakeside Motel
Location: 7424 Lakeshore Road, Lambton Shores, N0N 1J3
TO: COZYUPSTAYSLAKESIDE INC. o/a LAKESIDE MOTEL and all successors or assigns (collectively “Lakeside Motel”)
Assumption of Risk: I, the undersigned, acknowledge and agree that the use of a paddle board and/or life jacket involves inherent risks, including but not limited to, drowning, personal injury, and damage to property. I voluntarily assume all risks associated with the rental and use of the paddle board and/or life jacket, whether foreseen or unforeseen.
Waiver and Release: In consideration of being allowed to rent and use a paddle board and or life jacket from Lakeside Motel, I hereby release, waive, discharge, and hold harmless Lakeside Motel, its owners, agents, employees, and affiliates from any and all claims, demands, liabilities, or causes of action whatsoever arising out of or connected with my use of the paddle board and/or life jacket, including any claims arising out of negligence.
Indemnification: I agree to indemnify and hold harmless Lakeside Motel from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of or connected with my use of the paddle board and/or life jacket.
Safety Rules and Regulations: I acknowledge that I have received, read, and understood the safety rules and regulations provided by Lakeside Motel. I agree to wear a life jacket at all times while using the paddle board and to follow all safety instructions and guidelines.
Condition of Equipment: I agree to inspect the paddle board and/or life jacket and equipment prior to use and to notify Lakeside Motel of any defects or issues. I agree to ensure proper fit of the life jacket prior to use. I accept full responsibility for the care and condition of the paddle board and/or life jacket during the rental period and agree to return it in the same condition as received. If any paddle board, life jacket and/or equipment is damaged upon return, renter is responsible for the full replacement cost of the said item.
Personal Responsibility: I acknowledge that I am physically fit and capable of safely operating and using a paddle board. I agree to use the paddle board and/or life jacket responsibly and to exercise caution and common sense at all times.
Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of the Province of Ontario. Any legal action or proceeding arising out of or related to this waiver shall be brought exclusively in the courts of Ontario.
Severability: If any provision of this waiver and release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
